Privacy Policy

This Privacy Policy describes how PeakLink (“PeakLink,” “we,” “us,” or “our”) collects, uses, and shares personal information through our websites, apps, creator/practitioner dashboards, widgets, APIs, and related services that link to this Policy (the “Services”). We may provide additional notices for specific features; those notices control to the extent they differ.

By using the Services, you agree to this Policy. If you do not agree, please do not use the Services.

 


 

1) Roles & Key Definitions

  • Creator / Practitioner: a PeakLink user who builds a storefront (e.g., “link-in-bio”), publishes protocols/lists, and may earn commissions on eligible transactions.

  • Merchant / Brand: a participating company whose products/services appear on PeakLink and who may fund commissions, discounts, shipping/returns, or fulfillment.

  • Network Partner: a brand-run provider program, directory, or franchise that helps onboard and support practitioners/creators.

  • Visitor / Shopper: any person who views a storefront, protocol/list, or clicks a product/service link.

 


 

2) Information We Collect

a) Information you provide

  • Contact & profile: name, email, phone, practice/company, address, handle/username, password, photo, bio.

  • Commerce & payouts: order history, cart data, payout details (e.g., tax forms such as W-9/W-8 and identifiers needed for 1099/1042-S where applicable).

  • Content: storefronts, protocols/lists, reviews, comments, messages, media uploads, and associated metadata.

  • Health modules (opt-in): if you connect wearables or input wellness data (e.g., sleep, steps, heart rate, goals). See Section 4.

  • Invites: if you invite friends/clients, we process their name/email/handle solely to send the invitation and, where permitted, one reminder. Only share contacts you have permission to share.

  • Support: info you submit via support or chat (including AI-assisted support—see Section 5).

b) Information from third parties

  • Social/Platform sign-ins: if you connect Instagram, TikTok, YouTube, Google, Apple, etc., we receive limited account/profile info per your platform settings.

  • Merchants/brands & networks: catalog, pricing, availability, attribution, and reconciliation data tied to storefront/booking activity.

  • Analytics & anti-fraud partners: usage and integrity signals that help measure performance and protect the Services.

c) Information collected automatically

  • Device & usage: IP address, device type, OS, browser, language, app version, timestamps, pages/screens viewed, clicks, scrolls, referring/exit pages.

  • Cookies & similar tech: cookies, local storage, pixels/web beacons, and SDKs (details in Section 3).

  • Approximate location: e.g., country/city inferred from IP to localize content and detect fraud.

d) Session replay & diagnostics

We may use session-replay and telemetry tools (e.g., click/scroll replays, crash logs) to troubleshoot and improve usability. We configure tools to mask sensitive fields (e.g., passwords, full payment details) and contractually prohibit vendors from using your data for their own purposes.

California Notice at Collection. We collect the categories of personal information described in Sections 2–4 for the purposes set out in Sections 8–10. We retain each category for as long as needed to provide the Services, comply with law, prevent fraud, and for legitimate business needs, typically between 6–36 months depending on the data type, unless a longer period is required by law (see Section 14).

Sensitive Personal Information (SPI). If you choose to connect wearables/health modules, we may process SPI such as wellness metrics. We do not use or disclose SPI to infer characteristics about you. California residents may Limit Use of Sensitive Personal Information via the “Privacy Choices” link in the footer or by emailing support@ourpeakhealth.com.

 


 

3) Cookies, Analytics & Ads

Why we use cookies/SDKs

  • Necessary: run core features (authentication, security, preferences, session continuity).

  • Performance: understand how people use the Services and improve them (aggregate analytics).

  • Functional: remember choices (e.g., locale), personalize storefronts and recommendations.

  • Measurement (our campaigns): measure the effectiveness of our own ads—we do not “sell” personal information or “share” it for cross-context behavioral advertising as defined by applicable U.S. state privacy laws.

  • Browser/device controls: block/clear cookies in your browser; manage mobile ad identifiers in OS settings.

4) Health Modules & Wearables (Opt-In)

When you choose to connect a wearable or health app, PeakLink uses one or more health-data connection providers acting as our service providers/processors to link your account and sync only the categories you authorize (e.g., activity/steps, workouts, heart rate/HRV, sleep duration/stages, body metrics, SpO₂, and other wellness metrics). We do not receive precise GPS routes unless you explicitly opt in.

  • Use: to power features you enable (personalized recommendations, protocol adherence views), maintain the connection, prevent fraud/abuse, and improve the Services (including use of aggregated/de-identified analytics). We do not sell personal information or share it for cross-context behavioral advertising.

  • Control: you can disconnect at any time in PeakLink settings and/or in the source app; disconnection stops new syncing.

  • Security: tokens/credentials are encrypted at rest; access is role-restricted and logged. Our providers are contractually barred from secondary use and from retaining data longer than necessary.

  • Not medical/HIPAA: PeakLink is not a HIPAA covered entity or business associate; wearable data is used for consumer features only.

For residents of states with consumer health privacy laws (e.g., Washington, Nevada, Connecticut), the wellness metrics you choose to sync may be considered “consumer health data.” We collect and use this data only for the purposes you enable (see Section 4), do not sell it, do not use geofencing to target healthcare facilities, and disclose it only to service providers/processors or as required by law. You may request access/deletion or withdraw consent at any time (see Section 11).

 


 

5) AI Chat & Support

If you use PeakLink chat or AI-assisted support, your messages and context (e.g., page URL, device info) may be processed by vetted third-party AI providers acting as our processors to generate responses or triage support. We do not allow those providers to train their general models on your chats and require safeguards, access controls, and deletion schedules consistent with this Policy.

 


 

6) Social/Platform Connections & Google/YouTube APIs

If you connect social or platform accounts, we receive the minimal information needed to enable that connection, per your settings and the platform’s terms.

7) Payments & Payouts

Payments for purchases are processed by third parties (e.g., Stripe; we may also support PayPal in some flows). We do not store full payment card or bank account numbers on our systems.

    These processors adhere to PCI-DSS requirements.

For creator/practitioner payouts, we may use a payout partner. Your payout details are processed under that partner’s terms and privacy notices.

 


 

8) How We Use Information

  • Provide & operate the Services (shops, protocols/lists, search, bookings, payouts) and fulfill transactions with merchants/providers.

  • Personalize experiences (remember preferences, recommend content/products/services).

  • Communicate: service updates, security alerts, onboarding and educational emails; limited marketing where permitted (opt-out anytime).

  • Measure & improve: performance, quality, usability; develop new features.

  • Prevent fraud/abuse, enforce our Terms, and comply with law.

  • Research & analytics, including de-identified/aggregated reporting.

  • With consent where required.

Legal bases (EU/UK where applicable): contract performance, legitimate interests (e.g., security, product improvement), consent (where required), and legal obligations.

We may create aggregated, de-identified, and/or anonymized data and use/share it for lawful business purposes. We do not attempt to re-identify such data.

With your consent, we may send transactional or marketing texts. Message & data rates may apply. Message frequency varies. Reply STOP to opt out, HELP for help. Consent is not a condition of purchase.

 


 

9) Public Profiles & User Content

Creator/practice storefronts and other public content may be indexed by search engines and can be copied, cached, screen-captured, or re-shared by others. Removing content from PeakLink does not control third-party caches or copies. Only publish information you intend to be public.

 


 

10) How We Share Information

We share personal information in these situations:

  • Service providers & processors: hosting, analytics, security, support, session replay, AI/chat, email/SMS, fulfillment, payouts.

  • Merchants/brands & network partners: to fulfill orders, validate attribution, reconcile commissions, and provide support.

  • Linked third-party services: when you choose to connect them (per your settings).

  • Professional advisors: lawyers, auditors, banks, insurers (under confidentiality).

  • Legal & safety: to comply with law, protect rights, prevent fraud/abuse, or respond to lawful requests.

  • Business transfers: as part of financing, merger, acquisition, or asset sale (including due diligence).

  • Other users/the public: when you publish content or maintain public profiles.

We do not sell personal information and do not share it for cross-context behavioral advertising.

 


 

11) Your Choices & Rights

  • Disconnect integrations in Settings.

  • Access/Update account information in your dashboard.

  • Marketing opt-out via the email footer; you may still receive transactional messages.

  • Cookies/Ad controls: see Section 3.

  • Delete account: contact us (Section 16). We may retain certain information as required by law, for security/fraud prevention, or for legitimate business needs.

Additional rights (where applicable by law, e.g., EU/UK, certain U.S. states): access, correction, deletion, restriction, objection, portability, and withdrawal of consent. Submit requests to privacy@ourpeakhealth.com. We will verify and respond consistent with applicable law.

U.S. State Rights (CO, CT, VA, UT, OR, TX, etc.). Depending on where you live, you may have the right to request access, correction, deletion, portability, and to opt out of targeted advertising, sale, or certain profiling. Submit requests to privacy@ourpeakhealth.com

Appeal. If we deny your request, you may appeal by emailing privacy@ourpeakhealth.com with “Appeal” in the subject line. We will respond within the time required by law and explain our decision.

Global Privacy Control (GPC). Where required, we honor browser-based GPC signals as an opt-out preference.

Authorized Agents (California). You may designate an authorized agent to submit a request on your behalf. We will require proof of the agent’s authority and may verify your identity directly.

 


 

12) Direct Marketing

We may send you marketing about PeakLink features, events, and offers similar to your activity or interests, where permitted. You can opt out at any time using the link in our emails or by contacting us (Section 16).

Financial Incentives (California). From time to time we may offer discounts, perks, or other benefits in exchange for allowing us to use your personal information (e.g., email for a discount). Participation is voluntary. You may opt out at any time using the method provided with the offer or by contacting us. We reasonably estimate the value of the incentive based on the added revenue or insights generated minus program costs.

 


 

13) Security

We employ administrative, technical, and physical safeguards designed to protect personal information. No online system is 100% secure; use strong passwords and keep credentials confidential. We maintain incident response procedures and will notify you and/or regulators where legally required.

 


 

14) Data Retention

We retain personal information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, and for legitimate business purposes. Retention periods vary by data type and context.

 


 

15) Links to Other Sites/Services

The Services may link to or embed third-party sites, apps, or content (including creator/practice shops that reference third-party policies). We don’t control those third parties and aren’t responsible for their practices. Review their privacy policies before using their services.

 


 

16) International Transfers

We are based in the United States and may process data in the U.S. and other countries that may have different privacy laws than your region.

 


 

17) California & Nevada Notices

California “Shine the Light”. We do not disclose personal information to third parties for their own direct marketing. California residents may submit “Shine the Light” requests to privacy@ourpeakhealth.com (subject line: “Shine the Light”), including full name and mailing address.

Nevada. We do not sell personal information for monetary consideration. Nevada residents may submit an opt-out request for potential future sales to privacy@ourpeakhealth.com.

 


 

18) Children

The Services are not intended for individuals under 18. If you believe we collected a child’s data in violation of law, contact us; we’ll take appropriate steps to delete it.

 


 

19) Changes to this Policy

We may update this Policy from time to time. We’ll update the “Last Updated” date and, where required, provide additional notice (e.g., in-product or email). Your continued use after the effective date indicates acceptance.
